  • Multi-platform account management

Our Service integrates with third-party social media platforms. Your use of those platforms is subject to their respective terms and policies.

2. Account Registration and Eligibility

2.1 Eligibility

You must be:

  • At least 13 years old (or meet the minimum age in your jurisdiction)
  • Capable of forming a binding contract
  • Not prohibited from using the Service under applicable laws

2.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3. User Responsibilities and Conduct

3.1 You Agree To:

  • Violate any intellectual property rights or proprietary rights
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use automated systems (bots, scrapers) in violation of platform policies
  • Engage in spam, mass posting, or any form of abuse
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Use the Service to transmit viruses, malware, or any other malicious code
  • Resell, redistribute, or sublicense the Service without our written permission

4. Content and Intellectual Property

4.1 Your Content

You retain all rights to content you submit, post, or display through the Service ("Your Content"). By using our Service, you grant us a limited license to:

  • Store, process, and transmit Your Content to connected social media platforms
  • Display Your Content within the Service for account management purposes
  • Create backups and derivatives necessary to provide the Service

This license terminates when you delete Your Content or your account, except for content that has been shared with others or as required by law.

4.2 Our Content

All rights, title, and interest in the Service (excluding Your Content) are and will remain the exclusive property of FloPost. This includes:

  • Software, code, and algorithms
  • User interface and design elements
  • Trademarks, logos, and branding
  • Documentation and support materials

4.3 Content Responsibility

You are solely responsible for Your Content. We do not pre-screen content but reserve the right to review, monitor, and remove content that violates these Terms or applicable laws.

5. Platform Integrations

Our Service relies on APIs provided by third-party social media platforms. We are not responsible for:

  • Changes to platform APIs, features, or policies
  • Platform downtime, rate limits, or restrictions
  • Platform decisions to suspend or terminate your account
  • Content moderation or removal by the platforms

You acknowledge that your access to connected platforms is subject to their terms and may be revoked by those platforms at any time.

6. Payments and Subscriptions

6.1 Fees

Some features may require payment of fees. Current pricing is available on our website and may change with reasonable notice.

6.2 Billing

  • Subscriptions renew automatically unless cancelled
  • You authorize us to charge your payment method on file
  • Failed payments may result in service suspension
  • All fees are non-refundable except as required by law

6.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

7. Service Availability and Modifications

7.1 Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Emergency repairs
  • Third-party service failures
  • Circumstances beyond our reasonable control

7.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable for any modification, suspension, or discontinuation.

We may suspend or terminate your account immediately if you:

  • Engage in fraudulent or illegal activity
  • Fail to pay applicable fees
  • Create risk or legal exposure for us or other users

8.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately
  • We will delete your data according to our Privacy Policy
  • You remain liable for any fees incurred before termination
  • Sections that by their nature should survive will continue to apply

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of content
  • Warranties that defects will be corrected

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOPOST SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Loss of or damage to reputation
  • Business interruption or loss of business opportunities
  • Damages arising from errors, omissions, interruptions, defects, or delays
  • Actions or inactions of third-party platforms

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim or $100, whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless FloPost and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your Content

12. Privacy and Data

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@flopost.ai. We'll try to resolve the dispute informally by contacting you via email.

13.2 Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles.

13.3 Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration, except for disputes that may be taken to small claims court.

14. General Provisions

14.1 Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or prominent notice on the Service. Continued use after changes constitutes acceptance.

14.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FloPost regarding the Service.

14.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

14.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.5 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
